Welcome to The TRIO (the “Website”), operated by THE TRIO GLOBAL (business registration no. 202203183123) (“The TRIO”, “we”, “our” or “us”). These Terms & Conditions govern access to and use of the Website, enquiries, purchases of products or subscriptions sold by us, and requests for professional services, subject to any separate written agreement.
By browsing or using this Website you agree to the terms that apply to Website use. A binding agreement for paid professional services arises only when we and the client accept a quotation, statement of work, order, or other written agreement, or where an online order is accepted in accordance with the applicable checkout terms. If you disagree with these Terms, do not purchase or use the relevant services.
Contact: [email protected], Suite 1.03-25, Wisma Zara Business Centre, Kubang Kerian, 16150 Kota Bharu, Kelantan, Malaysia, or https://thetrio.my/hubungi/.
We may provide: (a) WordPress, WooCommerce, website development and related support; (b) digital marketing, including Meta Ads, Google Ads, SEO, AI-related search optimisation and content services; (c) custom systems, workflow automation and integrations using solutions proportionate to client needs; (d) business consultation and team development; and (e) digital products, software, educational materials, subscriptions or other items listed on our Website.
Website descriptions explain typical services, not a promise that every feature or outcome is included. The actual deliverables, dependencies, schedule, fees, support and exclusions for any project are specified in the accepted quotation or SOW.
A proposal or displayed starting price is indicative unless stated otherwise. The agreed quotation, SOW, purchase description, service agreement or invoice sets out the applicable scope, deliverables, milestones, payment terms, assumptions and exclusions.
If documents conflict, the order of precedence is: (1) the mutually accepted project service agreement or Statement of Work (SOW); (2) the accepted quotation for that project; and (3) these Website Terms & Conditions. A later change order will override an earlier document only to the extent that the parties expressly agree to amend the affected terms. Changes to scope must be agreed in writing, including any impact on price and timeline. Email or agreed project-management communication may serve as written evidence where appropriate.
The price, currency, deposit amount (if any), payment stages, due dates, milestones, renewal conditions and applicable taxes will be specified separately in the quotation, order or accepted SOW for each project. The TRIO does not impose one universal deposit percentage or milestone schedule across all projects. Advertising spend, hosting, domain names, software licences, payment gateway charges and third-party subscriptions are excluded unless expressly included.
Payments must be made through approved channels. We may pause work for a materially overdue invoice after providing reasonable written notice, subject to the specific contract and applicable law. Any late fees, non-refundable deposits or minimum commitment periods apply only if disclosed and agreed before purchase. Any deposit, milestone split, payment collection procedure or grace period is determined by the accepted quotation or written agreement for the relevant project.
Clients agree to provide accurate instructions, lawful content, necessary approvals, access and assets in reasonable time. Clients are responsible for ensuring they have rights to materials and credentials they supply. Where a deliverable depends on feedback, approvals, access to accounts or third-party service availability, the implementation timeline may be reasonably adjusted and communicated.
Project timelines are estimates unless a binding deadline has been expressly agreed. The TRIO should inform clients of material delays and propose reasonable next steps.
Unless a different arrangement is expressly agreed in writing, each project includes up to three (3) rounds of revisions within the original agreed scope. The SOW or quotation may define the stages to which these rounds apply and how feedback is consolidated. A revision adjusts work within the agreed scope; a new function, substantial change of direction, added integration or expanded content may require a separate quotation or written change order.
When deliverables are submitted for review, clients should assess them against the agreed acceptance criteria and communicate any issues within the agreed review period. The review and acceptance period, including any escalation process, will be specified in the accepted quotation or SOW. Silence alone should not be treated as acceptance unless that mechanism was expressly disclosed and agreed.
Each party retains ownership of intellectual property and materials it owned before the engagement. Clients retain rights to content, brand assets and materials they lawfully provide.
Ownership or licences in deliverables created specifically for a client, including website designs, custom code, copy, graphics, databases, source files and documentation, will be governed by the accepted SOW or written contract, including any conditions tied to full payment. The applicable ownership, assignment, licensing, access and source-code handover arrangements must be expressly stated in the SOW for each project; no blanket transfer of source-code ownership is assumed.
Third-party themes, plugins, stock assets, fonts, APIs, cloud products and open-source components remain subject to their own licence terms. The TRIO cannot grant broader rights than the applicable rights holder allows. Reusable tools, methods, templates and pre-existing libraries are not transferred unless agreed in writing.
Neither party may use the other’s trademarks or publish a project as a case study without appropriate permission or other valid legal basis.
Project handover items (for example: login credentials, administrator roles, deployed code, data exports, documentation or training) must be stated in the SOW. The client should designate authorised users and safeguard access credentials.
The TRIO will take reasonable precautions when handling access and production systems. Any migration, major integration or release may require backups, staging and agreed downtime or rollback procedures. Security, availability or error-free operation cannot be guaranteed absolutely. The warranty or post-launch bug-fix period (if any), maintenance responsibilities, monitoring, support response commitments and incident-response scope are determined by the accepted quotation or SOW for that project.
Domain registration, hosting/VPS, software subscriptions, payment gateways, SSL certificates, third-party integrations and platform accounts may carry separate provider terms, costs, limitations, renewal dates, suspension rules and privacy practices.
Hosting, maintenance, security monitoring, backups, licences, renewals and support are included only to the extent specified in the accepted quotation or SOW for the particular project. Website launch or handover does not automatically include unlimited updates, vulnerability scanning, malware removal, uptime monitoring or recovery assistance. Any maintenance scope, response times, backups and restoration targets must be defined in the applicable plan or SLA.
Where third-party outages, product changes or licence expiries affect a service, we will use reasonable efforts within our agreed scope but do not control the third-party provider.
Marketing engagements may depend on advertising platforms, customer demand, campaign learning periods, the client’s offer, landing pages, sales follow-up and other factors outside our control. Unless expressly stated in an accepted contract, The TRIO does not guarantee a specific Google ranking, ad-account approval, sales volume, return on ad spend, leads or revenue.
Advertising spend belongs to the campaign budget specified in the SOW and is separate from management fees unless expressly included. The ownership, administrator access, billing, pixels, conversion tracking, ad accounts and creative assets should be clarified before campaign launch.
Clients must provide truthful claims and comply with applicable laws and platform advertising policies; we may reject instructions that are unlawful or deceptive.
Our consultation, workflows, templates and recommendations are intended to support business decisions and implementation. They do not replace legal, tax, accounting, regulated financial or other licensed professional advice unless explicitly contracted with an appropriately qualified professional.
System and automation results depend on agreed requirements, data quality, integrations and usage. Clients should validate critical financial, operational and customer-facing outputs before reliance or deployment.
Digital products may include downloadable resources, software, templates, e-books, training or access to subscription services. The product page or checkout must state what is supplied, how access is granted, permitted usage, device/user limits if any, subscription periods, renewal arrangements and any support provided.
Unless a product licence expressly permits otherwise, purchases do not transfer copyright or grant a right to resell, redistribute, share login access, reverse-engineer where prohibited by law, or claim authorship of the purchased materials.
Depending on the product, a subscription may renew automatically or require manual renewal. The applicable renewal method, term, recurring charge (if any), minimum commitment, cancellation deadline and means of stopping future charges must be clearly disclosed on the product page or at checkout before payment.
Refund and cancellation requests are handled in accordance with the separate Return & Refund Policy at https://thetrio.my/return-and-refund-policy/, the accepted project or subscription agreement and any non-excludable rights under Malaysian law.
Where an agreed project deposit has been paid and work has commenced, that deposit is generally non-refundable to the extent permitted by applicable law and the accepted quotation or SOW. This does not exclude statutory consumer rights or remedies for a breach by The TRIO. Any further cancellation settlement will account for agreed milestones, work reasonably performed, approved third-party costs and sums already paid, subject to the specific agreement and applicable law.
Either party may seek termination in accordance with the applicable contract, including procedures for material breach, notice and a reasonable opportunity to remedy where appropriate. Following termination, the parties should agree on handover, outstanding payments, access revocation, data return and retention.
Personal information collected through this Website is addressed in our Privacy Policy: https://thetrio.my/privacy-policy/. In client projects, the parties should also document responsibility for personal data, permissions, instructions, retention, backups, breach handling and cross-border services where relevant.
Each party should protect the other’s non-public commercial information, access credentials and confidential project information and use it only for authorised purposes, subject to applicable laws and agreed exceptions. A separate confidentiality agreement or data processing agreement may be required for sensitive client projects.
Articles or recommendations may contain affiliate/referral links to software, hosting, payment gateways, SaaS or other products. We may receive a commission or other benefit if users purchase through these links, without necessarily changing the user’s price. An affiliate relationship does not make The TRIO the provider or warrantor of a third-party service.
Information on the Website is intended to be helpful and is updated periodically, but product pricing, features, eligibility and external offers can change. Check provider terms and official pricing before purchasing. Third-party links and services are governed by their providers’ terms and privacy policies.
You agree not to misuse the Website or services, interfere with security or availability, attempt unauthorised access, upload malware, infringe intellectual property rights or use the Website for unlawful activities.
Unless otherwise stated, Website text, graphics, brand elements and other content are owned by The TRIO or licensed to us. You may browse and share links to our public pages but may not reproduce commercial materials beyond permissions available under law or an express licence.
The TRIO will perform contracted services with reasonable care and skill consistent with the applicable scope. To the extent permitted by applicable law and subject to the agreed contract, neither party should be held responsible for losses caused solely by external systems or events outside its reasonable control.
No fixed monetary cap on liability is established by these Website Terms. Any project-specific limitation of liability, exclusions, exceptions or allocation of risk must be expressly agreed in the relevant SOW or service agreement and is subject to applicable Malaysian law. Nothing in these Terms excludes or limits liability or statutory rights that cannot lawfully be excluded or limited.
Nothing in these Terms excludes or restricts rights or remedies that cannot legally be excluded under Malaysian law.
If an issue arises, please contact us at [email protected] and provide relevant order details or a description of the concern. We aim to review concerns in good faith and communicate next steps within a reasonable period.
The parties should first attempt a good-faith resolution. These Terms are governed by the laws of Malaysia, without limiting any mandatory rights or remedies available under applicable law.
We may update these Website Terms from time to time by posting a new version with an updated effective date. Material changes affecting an existing paid service agreement will not automatically alter that agreement unless permitted by the contract and applicable law or expressly accepted by the parties.
